The Swagatam Collaborative Application Development Platform has been designed, developed and hosted by Department of Electronics and Information Technology, Ministry of Communications & IT, Government of India. By using Swagatam, you agree to be bound by the terms of use of this platform. Violation of any of the terms below will result in the termination of your account. This platform is being provided on an 'as is, where is' basis. By using Swagatam, you agree to use it at your own risk.
Description of Service
Swagatam is a platform for the collaborative development of e-government applications. The services provided on the platform include but are not limited to - creating an account, creating projects, downloading source code, contributing source code, participating in discussions, wikis, feedback, documentation, bug tracking, project tracking etc.
Using Swagatam, Opening a Project or Cancelling a Project
Access to Swagatam is public. Anyone may view, download and reuse its items or components in accordance with the associated licenses.
Anyone can open an account by providing the required signup information. They can propose a project, but Swagatam reserves the right to allow or disallow the project based on its sole discretion of whether or not the project is related to e-governance and is of larger public use. Each project that gets allowed will be under the responsibility of its project owner. Once allowed, the project owner is free to allocate and organize the means and resources required for the development and success of the project.
Users can cancel their account at any time by logging into their profile. All the content will be immediately deleted upon cancellation; this is an irretrievable process.
Responsibility and Ownership of Content
Swagatam does not have any intellectual property rights over the content uploaded and hosted on the platform by users. All content or materials provided - whether source code, data, text, software, music, sound, photographs, video, messages or any type of information uploaded to Swagatam is the sole responsibility of the user uploading it.
However, by setting the project and its pages to be viewed publicly, users agree to allow others to view that content. By setting repositories to be viewed publicly, users agree to allow others to download and reuse those repositories. When users create a project, they are free to assign it any license they wish, which shall be applicable on other users of the platform.
Swagatam does not actively pre-screen content, but it reserves the right to refuse or remove any content or account that in its sole discretion is found to be unlawful, offensive, threatening, promoting violence, defamatory, pornographic, or violating Swagatam's Terms of Service, Privacy Policy, Code of Conduct or violating any other user or party's intellectual property rights.
Limitation of Liability
Swagatam does not guarantee that the platform shall meet any specific requirements, or that it will be available uninterrupted, or that it is secure, encrypted and error-free, or that the results obtained using the platform will be accurate or reliable, or that the quality of any products, services, information available on the platform will meet user expectations.
Users expressly understand and agree, that in no event will the Government of India be liable for any expense, loss or damage including, without limitation, indirect or consequential loss or damage, or any expense, loss or damage whatsoever arising from use, or loss of use, of data, arising out of or in connection with the use of Swagatam.
Right to Modify or Terminate
Swagatam reserves the right at any time to modify or discontinue, temporarily or permanently, the Service (or any part of it), with or without notice. Swagatam in its sole discretion reserves the right to suspend or terminate any user account and refuse any current or future use of the platform for any reason at any time. Such termination may result in the deactivation or deletion of the account, and the loss of all the content hosted therein.
Applicable Law
These terms and conditions shall be governed by and construed in accordance with the Indian Law. Any dispute arising under these terms and conditions shall be subjected to the exclusive jurisdiction of the courts of India.
